Appraisal claimants who wish to accept the appraisal award without an
additional settlement payment will find instructions on page 22. Those
of you who wish to consider an appeal of any of the orders in the
case, or who wish to negotiate a settlement of your rights to appeal,[1]
should of course confer with legal counsel.
Congratulations to all of you who benefited from this important case,
and also to all of you who will benefit from its demonstration of a
process that assures investors a right to realize the fair value of
corporate stock.
Both congratulations and gratitude are due to each of you who
supported this project with your views, your professional skills, or
your investments. We must especially thank Cavan Partners and its
managing member, John Tully, who initially volunteered in March 2013
to support a relatively simple delegate demand for records[2]
and then agreed to serve as the Forum’s representative petitioner to
initiate the appraisal case in October 2013[3]
for what turned out to be more than three years of enduring support.
